DELIVERY OF PRODUCTS AND RELATED COSTS
The purchased products will be delivered to the address indicated by the Customer in the Order within 24-48 hours of acceptance of the Order by FALASCA for products ready for delivery , at the cost specifically indicated on the Site before sending the Order.
FALASCA reserves the right to accept or not deliveries requested outside the Italian or European borders. In any case, for deliveries to be made outside the Italian borders, shipping costs and delivery times may vary.
For deliveries requested in countries outside the European Union, any import customs charges will be borne by the recipient. The Customer is therefore invited to contact the customs authorities of his/her country in advance to verify the costs and any import limits.
Personalization may cause delays in deliveries. The delivery times indicated by FALASCA must be considered as purely indicative and a delay with respect to the same, or any delivery made with subsequent split shipments does not entitle the Customer to refuse the delivery itself and to request compensation or indemnity.
Upon delivery of the products, the Customer is required to check: that the number of packages delivered corresponds to that indicated in the transport document, that the packaging is intact, not damaged, not wet or in any way altered, including the closing materials (adhesive tape or metal straps).
Any damage to the packaging and/or the product or any discrepancy in the number of packages or indications must be immediately reported by making a specific note on the delivery document of the product to be returned to the courier.
Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 7 days of delivery, according to the methods set out in this document.
Returns and Refunds
RIGHT OF WITHDRAWAL
- Pursuant to art. 52 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the Customer may withdraw from the Conditions and therefore from the purchase contract for any reason, without the need to provide reasons and without any penalty, within 14 (fourteen) working days from the date of receipt of the products.
- To exercise the right of withdrawal referred to in the previous article 5.1, the Customer must send Falasca a communication to this effect, within the terms indicated, to the following email address info@poshead.com.
- In the event of withdrawal, the Customer must return the products to Falasca at his/her own expense within 14 (fourteen) days of the withdrawal itself, to the following address: Falasca Sas Via della Nocetta 109, 0016 ROME.
The goods must be returned intact, complete with all their parts and in their original packaging (envelopes and boxes), stored and possibly used for the time strictly necessary to establish and verify their nature, characteristics and size, according to normal diligence, without there being any signs of wear or dirt, in compliance with the conditions set out below:
the right of withdrawal cannot be applied to products customized by the customer;
the right of withdrawal may be applied to the product purchased in its entirety; it is not in fact possible to exercise withdrawal only on part of the product purchased (e.g.: accessories, complements, etc.);
for withdrawal to be possible, the product must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: labels, tags, tags, etc.);
shipping costs (and any customs charges, if applicable) for returning the goods will be borne exclusively by the Customer.;
the shipment, until the certificate of receipt in the warehouse indicated by Falasca, is under the complete responsibility of the customer;
in the event of damage to the goods during transport, Falasca will notify the Customer, to allow him to promptly file a complaint against the courier chosen by him and obtain the relevant reimbursement; the product will then be made available to the Customer, simultaneously cancelling the request for withdrawal;
Falasca will not be liable in any way for damage, theft, loss occurring during or in any way dependent on the return shipment.
- Falasca will refund the Customer the entire amount already paid, net of any additional shipping costs pursuant to art. 56, paragraph 2, of Legislative Decree 21/14), within 14 (fourteen) days of withdrawal, through a reversal procedure of the amount charged, using the same payment method used by the Customer for the initial transaction, unless otherwise agreed. In any case, the Customer will not bear any costs as a consequence of said refund. Falasca may suspend the refund until receipt of the returned product or until the Customer demonstrates that he has correctly returned the product, if earlier.
- In any case, the Customer will lose the right of withdrawal in cases where Falasca ascertains that:
the returned product and/or its accessories, and/or its packaging are not intact;
the product is missing its external packaging and/or the original internal packaging;
the product is missing integral elements and/or accessories (e.g. closures, laces, buckles, etc.).
In the event of forfeiture of the right of withdrawal, Falasca will return the purchased product to the sender, charging the latter the shipping costs and, if already refunded, the price of the product.
Guarantees
- All products sold by Falasca are covered by a 24 (twenty-four) month warranty for defects of conformity, pursuant to Title III of Legislative Decree 206/2005. To benefit from warranty assistance, the Customer must keep the invoice, or the payment receipt, together with the transport document.
- The guarantee for lack of conformity will apply provided that the relevant product has been used correctly, in compliance with its intended use.
- In the event that, for any reason, Falasca is unable to return to the Customer a product under warranty (repaired or replaced), or if the repair or replacement were, also in light of the value of the product, excessively expensive, Falasca may proceed with an appropriate reduction of the price paid, or with the refund of the entire amount paid with termination of the contract.
- In cases where the application of the guarantees requires the return of the product, the same must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment). All products sold by Falasca are covered by a 24 (twenty-four) month guarantee for defects of conformity, pursuant to Title III of Legislative Decree 206/2005.
